Terms of Service

Overview

These Terms of Service (“Terms”) govern your use of the Dusk application and related services (“Service”) provided by Estate Media (“we”, “our”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Use of Service

Dusk is a real estate photography platform that enables licensed real estate agents to capture, upload, and receive professionally edited listing photos. You agree to:
  • Provide accurate account information
  • Use the Service only for lawful real estate photography purposes
  • Not share your account credentials with others
  • Not attempt to reverse engineer, modify, or disrupt the Service
We reserve the right to suspend or terminate accounts that violate these Terms.

Credits and Payments

The Service uses a credit-based system. Credits are consumed when edited photos are delivered. Credit balances are non-refundable and non-transferable, but they do not expire. Pricing is displayed in Canadian Dollars (CAD) unless otherwise indicated. Payments are processed securely by Stripe. We do not store your payment card details. All sales are final. If you believe a charge was made in error, contact us at the email address below.

Photo Content and Ownership

You retain ownership of all photos you capture and upload through Dusk. By uploading photos, you grant us a limited licence to process, edit, store, and deliver them back to you. We do not claim ownership of your content. We may use anonymised, non-identifiable examples of edited photos for promotional purposes only with your prior written consent.

Account Termination

You may delete your account at any time from the app settings. Deleting your account will permanently remove your personal information, property records, photos, and credit balance. This action cannot be undone. We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used the Service in a manner that could harm other users or our infrastructure.

Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for any losses resulting from service interruptions.

Limitation of Liability

To the maximum extent permitted by law, Estate Media and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or business interruption. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Estate Media from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending an email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
